(1) If a person in lawful custody escapes or is rescued, the person from whose custody he escaped or was rescued may immediately pursue and arrest him in any place in India.
(2) The provisions of Section 47 shall apply to arrests under Sub-Section (1) although the person making any such arrest is not acting under a warrant and is not a police officer having authority to arrest.
Important Sub-Sections Explained
Sub-section (1)
This sub-section grants immediate power to the individual from whose custody a person has escaped or been rescued to pursue and re-arrest them anywhere within India.
Sub-section (2)
It clarifies that Section 47, which deals with searching a place entered by a person sought to be arrested, applies to these re-arrests, even if the arrester is not a police officer or acting under a warrant.
