310(5): डकैती करने के प्रयोजन से एकत्रित होना—जो कोई डकैती करने के प्रयोजन से एकत्रित 5 या अधिक व्यक्तियों में से एक होगा, वह 7 वर्ष तक के कठिन कारावास से, और जुर्माने से दंडनीय होगा।

डकैती के लिए खण्डहर में इकट्ठा होना! (Assembling for Dacoity)। यह डकैती की दूसरी 'तैयारी' की धारा है। अगर 5 लोग रात के समय किसी सूने जंगल, खण्डहर या अड्डे पर 'इकट्ठा' (Assemble) होते हैं, और उनका मक़सद डकैती डालना है। तो भले ही उन्होंने अभी तक किसी हथियार को हाथ न लगाया हो या कोई 'मैप' न देखा हो (Preparation 399), सिर्फ उस 'बुरी नीयत से इकट्ठा' होने के कारण ही BNS 310(5) (पुरानी IPC 402) के तहत उन्हें 7 साल के लिए जेल भेज दिया जाएगा।
तुलना
Assembly (402) और Preparation (399) दोनों ही Criminal Act से पहले के चरण हैं, लेकिन डकैती (Dacoity) के मामले में दोनों दंडनीय (Punishable) अपराध हैं।
