BNS 63 defines rape (बलात्संग). The definition and the seven circumstances under which a sexual act amounts to rape are kept exactly the same as IPC 375. (Exception: Marital rape exception is retained).

बलात्कार (Rape) क्या है! निर्भया केस के बाद इस परिभाषा को बहुत विस्तृत (Broad) कर दिया गया था। अगर कोई पुरुष किसी महिला की 'इच्छा के विरुद्ध (Against her will)' या 'सम्मति के बिना (Without Consent)' या 'डरा-धमका कर' उसके शरीर के साथ किसी भी प्रकार का यौन कृत्य (पेनिट्रेशन) करता है, तो वह 'बलात्संग' (Rape) है। अगर लड़की 18 वर्ष से कम उम्र (Minor) की है, तो उसकी 'सहमति' का कोई मोल नहीं होता—वह भी रेप ही माना जाएगा। इसे BNS 63 (पुरानी IPC 375) में विस्तार से समझाया गया है। (इसमें मैरिटल रेप को अभी भी अपराध नहीं माना गया है)।

बलात्कार (Rape) की वृहद परिभाषा में 2013 के संशोधन के बाद जो बदलाव हुए थे, उन्हें BNS 63 में वैसा ही रखा गया है।
