एतस्मिन्पश्चात् अपवादित दशाओं को छोड़कर, आपराधिक मानव वध हत्या (Murder) है, यदि वह कार्य, जिसके द्वारा मृत्यु कारित की गई हो, मृत्यु कारित करने के आशय (Intention) से किया गया हो… या ऐसी शारीरिक क्षति करने के आशय से किया गया हो जो प्रकृति के सामान्य अनुक्रम (Ordinary course of nature) में मृत्यु कारित करने के लिए पर्याप्त हो।

अपवादित दशाओं को छोड़कर, आपराधिक मानव वध हत्या है, यदि वह कार्य जिसके द्वारा मृत्यु कारित की गई हो, मृत्यु कारित करने के आशय से किया गया हो… या ऐसी शारीरिक क्षति करने के आशय से किया गया हो जो प्रकृति के सामान्य अनुक्रम में मृत्यु कारित करने के लिए पर्याप्त हो।

मर्डर क्या है? (What is Murder?)। अगर किसी ने पक्की प्लानिंग करके (Intention), या शरीर के ऐसे नाज़ुक हिस्से (जैसे सिर या दिल) पर इतनी गहरी चोट मारी है जिससे 'निश्चित रूप से (Sufficient in ordinary course)' उस आदमी की मौत ही होगी। तो कानून की नजर में यह 'हत्या (Murder)' है। BNS 101 (IPC 300) सिर्फ 'मर्डर' की परिभाषा बताती है। इसमें 5 अपवाद (Exceptions) भी हैं, जैसे अचानक उकसावे (Grave and sudden provocation) में किया गया वध मर्डर नहीं माना जाता।
तुलना
यह Murder को डिफाइन करता है। सभी ‘Murder’ Culpable Homicide होते हैं, लेकिन सभी ‘Culpable Homicide’ Murder नहीं होते।
