जो कोई किसी व्यक्ति को उस व्यक्ति की, या उस व्यक्ति की ओर से सम्मति (Consent) देने के लिए विधिक रूप से प्राधिकृत किसी व्यक्ति की सम्मति के बिना भारत की सीमाओं से परे ले जाता है (Conveys beyond the limits of India), वह भारत में से उस व्यक्ति का व्यपहरण करता है।

137(1): जो कोई किसी व्यक्ति को उस व्यक्ति की, या उस व्यक्ति की ओर से सम्मति देने के लिए विधिक रूप से प्राधिकृत किसी व्यक्ति की सम्मति के बिना भारत की सीमाओं से परे ले जाता है, वह भारत में से उस व्यक्ति का व्यपहरण करता है।

देश के बाहर ले जाना! अगर किसी व्यक्ति (चाहे बच्चा हो या बड़ा) को उसकी मर्जी के बिना, या उसके परिजनों (Guardians) की मर्जी के बिना ज़बरदस्ती 'भारत की सीमा' (India's border) से बाहर (जैसे नेपाल या दुबई) ले जाया जाता है। तो इसे 'भारत में से व्यपहरण' (Kidnapping from India) कहते हैं। यह मानव तस्करी (Human Trafficking) से भी जुड़ा बड़ा अपराध है।
