धारा 361
जो कोई किसी अवयस्क (Minor – 16 वर्ष से कम का पुरुष, 18 वर्ष से कम की स्त्री) या किसी विकृतचित्त (Unsound mind) व्यक्ति को, उसके विधिपूर्ण संरक्षक के संरक्षण में से (Out of the keeping of lawful guardian) संरक्षक की सम्मति के बिना ले जाता है या बहका ले जाता है (Entices), व्यपहरण करता है।

137(2): जो कोई किसी अवयस्क (Minor – 18 वर्ष से कम आयु) यदि वह पुरुष है या स्त्री है, या विकृतचित्त व्यक्ति को, उसके विधिपूर्ण संरक्षक की सम्मति के बिना… व्यपहरण करता है। BNS makes the age of minor 18 for both boys and girls.

नाबालिग बच्चों की किडनैपिंग! बहुत बड़ा बदलाव (Major Change)! पुरानी IPC 361 में अगर लड़के की उम्र 16 साल से कम और लड़की की 18 साल से कम हो, तब उसे 'नाबालिग (Minor)' माना जाता था। लेकिन नए कानून BNS 137(2) ने लड़का और लड़की 'दोनों के लिए' उम्र '18 साल' (18 Years) तय कर दी है। यानी अगर 17 साल के लड़के को भी कोई बिना उसके माता-पिता (Lawful Guardian) की मर्जी के बहला-फुसला कर ले जाता है, तो अब वह 'किडनैपिंग' का गंभीर अपराध होगा।
तुलना
BNS में एक बहुत ही महत्वपूर्ण बदलाव यह है कि Kidnapping के लिहाज़ से ‘लड़के (Male)’ की उम्र 16 से बढ़ाकर 18 वर्ष कर दी गई है। अब 18 से कम उम्र का लड़का या लड़की दोनों समान रूप से संरक्षित हैं।
