जो कोई किसी व्यक्ति का व्यपहरण या अपहरण (Kidnaps or abducts) इस आशय से करेगा कि उस व्यक्ति को गुप्त रूप (Secretly) से और सदोष परिरुद्ध किया जाए… 7 वर्ष की अवधि के कारावास से, और जुर्माने से दंडनीय।

धारा 139
139: जो कोई किसी व्यक्ति का व्यपहरण या अपहरण इस आशय से करेगा कि उस व्यक्ति को गुप्त रूप से और सदोष परिरुद्ध किया जाए… 7 वर्ष तक के कारावास और जुर्माने से दंडित किया जाएगा।

छुपकर घर या तहखाने में बंदी बनाना! (Secret Confinement)। अगर कोई व्यक्ति अपने किसी दुश्मन को पकड़कर (अपहरण करके) अपने फार्महाउस के बेसमेंट या तहखाने में ऐसे 'गुप्त (Secret)' तरीके से कैद कर दे, जहाँ उसके घरवालों या पुलिस को भनक तक न लगे। इस तरह उसे बाहरी दुनिया से काट देने (Hostage in secret) पर पुलिस BNS 139 (पुरानी IPC 365) लगाकर ऐसे अपराधी को 7 साल के लिए जेल (गैर-जमानती) भेजती है।

अपहरण करके किसी को ‘गुप्त स्थान’ पर छुपाने के लिए यह धारा लगती है (सामान्यतः 363/364 के साथ)।
