163: सैनिक को भगोड़ा होने के लिए दुष्प्रेरित करना (2 वर्ष)। 164: ऐसे भगोड़े सैनिक को घर में छिपाना/आश्रय देना (2 वर्ष)। अपवाद (Exception) समान है।

यदि युद्ध के मैदान से या ड्यूटी से कोई फौजी भागकर आ जाए (Deserter), और आप उसे अपने घर में छिपा लें, तो BNS 164 (IPC 136) के तहत आपको 2 साल की जेल होगी। **परन्तु**, कानून में एक प्यारा अपवाद है: यदि भगोड़े फौजी की पत्नी उसे घर में छिपाती है, तो कानून पत्नी को सजा नहीं देता।
