BNS 165 (IPC 137) वाणिज्यिक जहाज (Merchant Ship) के कप्तान पर लागू होती है। यदि कप्तान की लापरवाही से कोई सेना से भागा हुआ भगोड़ा जहाज में छिपकर देश से बाहर भागने की कोशिश करे, तो कप्तान पर जुर्माना लगाया जाता है। BNS में जुर्माने की राशि ₹500 से बढ़ाकर ₹50,000 कर दी गई है।
