जो कोई आपराधिक अतिचार (Criminal trespass) करेगा, वह दोनों में से किसी भांति के कारावास से, जिसकी अवधि 3 मास तक की हो सकेगी, या जुर्माने से जो 500 रुपये तक हो सकेगा, या दोनों से दंडित किया जाएगा।
BNS (नया कानून)
धारा 329(3)
329(3): जो कोई आपराधिक अतिचार करेगा, वह 3 मास तक के कारावास से, या 5000 रुपये तक के जुर्माने (Fine increased) से, या दोनों से दंडित किया जाएगा।
विशेषज्ञ टिप्पणी (Expert Analysis)
प्लॉट या खेत में घुसने पर जुर्माना बढ़ा! (Punishment for Trespass)। किसी खाली प्लॉट या खेत में बिना इजाज़त घुसने (आपराधिक अतिचार) पर पहले मात्र 500 रुपये जुर्माना होता था (IPC 447)। लेकिन नए कानून BNS 329(3) में जेल की सजा तो 3 महीने ही रखी गई है, लेकिन जुर्माने की रकम को 10 गुना बढ़ाकर '5000 रुपये (Five Thousand)' कर दिया गया है।
तुलना
Fine Revision: साधारण अतिचार के लिए सजा अवधि (3 महीने) समान है, परंतु जुर्माने को 500 रुपये से बढ़ाकर 5000 रुपये कर दिया गया है (BNS 329-3)।
