धारा 422
जो कोई किसी ऋण या मांग (Debt or demand) को जो स्वयं उसका है या किसी अन्य व्यक्ति का है… विधि के अनुसार उस व्यक्ति के लेनदारों के संदाय (Payment of creditors) के लिए उपलब्ध होने से बेईमानी से या कपटपूर्वक रोकता है (Prevents)… 2 वर्ष + जुर्माना।

321: ऋणों को लेनदारों के लिए उपलब्ध होने से बेईमानी से निवारित करना… 2 वर्ष तक के कारावास या जुर्माना या दोनों।

उगाही या कर्जे के पैसे को छिपाना! मान लीजिए 'A' ने 'B' से 10 लाख उधार लिए थे। अब कोर्ट ने कहा है कि 'A' के सारे पैसे ज़ब्त करके 'B' को दिए जाएं। इसी बीच 'C' (जिसने 'A' के पैसे देने थे) 'A' के साथ मिलकर यह 'झूठा' नाटक करता है कि उसने कोई पैसा 'A' को नहीं देना, और 'A' भी उस कर्ज (Debt) को छोड़ देने (Release) का नाटक करता है ताकि कोर्ट 'B' को वह पैसा न दिला सके। इस 'मिलीभगत वाली धोखाधड़ी' (Preventing debt) के लिए BNS 321 (IPC 422) में 2 साल की सजा है।

संपत्ति के साथ-साथ ‘Debt’ (ऋण) को भी फर्जी रूप से ख़त्म (Fraudulent release of claim) करने को BNS 321 में दंडनीय अपराध रखा गया है।
