Full Definition & Explanation

Article 77 of the Indian Constitution governs how the Government of India conducts its business. It establishes that all executive actions must be taken in the name of the President of India. This means that every decision made by the government, whether it involves laws, policies, or administrative orders, is officially recognized as being carried out under the authority of the President. This gives the President a key ceremonial role while ensuring that the actual governance is carried out by the elected representatives and ministers. The article also mentions that any orders or instruments executed in the name of the President need to be authenticated according to rules set by the President. This authentication process ensures that there is a clear record of actions taken and helps maintain accountability. If there are questions regarding the validity of these actions, they cannot be dismissed simply because they were not directly signed by the President, which adds a layer of legal protection to the government’s decisions. Additionally, Article 77 allows the President to create rules for the efficient transaction of government business. This means the President can allocate responsibilities among ministers and set procedures to streamline operations. This is particularly key in a large and diverse country like India, where effective governance requires coordination among various ministries. Overall, Article 77 plays a key role in ensuring that the Indian government operates smoothly under the constitutional framework, balancing authority and accountability.

Historical Context

Article 77 was included in the Constitution when it was adopted in 1950. During the Constituent Assembly debates, members highlighted the necessity of maintaining a clear and accountable structure for executive actions to avoid arbitrary governance. They were particularly concerned about how executive power should be exercised responsibly, ensuring that the President’s role was ceremonial while empowering elected ministers. The article has remained unchanged since its inception, reflecting a consensus on the relationship between the executive and the President. The Supreme Court has addressed this article in several cases, emphasizing the importance of adhering to established rules for government actions. Notable cases like ‘Keshavananda Bharati v. State of Kerala’ reinforced the need for checks and balances in executive decisions.
